An appeals court has allowed Kars4Kids to resume airing its jingle in California while the charity pursues an appeal of a lower court ruling that found the ad violated state false advertising and unfair competition laws, according to NBC News.
The May 8 decision by Orange County Superior Court Judge Gassia Apkarian determined that the charity's ads deceived donors by leaving out any mention of its religious ties, a violation of state false advertising law, according to NBC News. Under the ruling, any continued use of the jingle in California required ads to carry a spoken disclosure of the charity's religious identity, with a 30-day deadline to comply, according to NBC News.
"Kars4Kids applauds today's court ruling allowing its ads to continue airing in California while the appeals process continues," a Kars4Kids spokesperson told NBC News. "We believe the lower court's findings on the facts and the law were deeply flawed, and we look forward to pursuing a broad appeal of that decision."
