After years of self-driving bravado, Tesla now has 60 days to prove Autopilot is actually autonomous in California or admit it's just driver assist with a fancy name

California just handed Tesla $TSLA a dictionary — and a deadline. The state's DMV said Tuesday that the company misled drivers by using the names “Autopilot” and “Full Self-Driving” (FSD) for driver-assistance software that still very much needs a human in the driver’s seat, and it gave the company 60 days to either drop the Autopilot label on non-self-driving systems or risk a 30-day suspension of its California dealer license.
The decision is pretty specific. California adopted an administrative decision from Judge Julie Cox that says Tesla’s continued use of the Autopilot name for advanced driver-assist features that aren’t SAE Level 3 or higher violates California consumer and vehicle law. On paper, the DMV suspended Tesla’s dealer license for 30 days. In practice, that suspension is parked for now: Tesla has a 60-day window to tell the state that it has stopped using the Autopilot label on non-autonomous systems or upgraded the software enough to actually qualify as a true self-driving system. If Tesla does neither, then the 30-day sales freeze kicks in.
The fight is really over the company’s sales pitch — that drivers can “drive,” no hands required. Starting in 2021, Tesla promoted its advanced driver-assist bundle with language about handling “short and long-distance trips with no action required by the person in the driver’s seat,” the DMV said. And California is treating that line as Exhibit A for why the branding crosses from aspirational to deceptive. The DMV notes that cars equipped with these features couldn’t then — and still can’t now — operate as autonomous vehicles, even as the company wrapped them in names that imply exactly that.
The DMV first accused Tesla of false advertising around Autopilot and FSD in 2022. Federal investigators have spent years probing Autopilot’s role in crashes. Class-action lawyers have argued that years of self-driving hype pumped up everything from resale values to the stock price. Through all of that, Tesla has repeated the same line: The company says it has “clearly and consistently” told customers that Autopilot and FSD need supervision and that drivers are still responsible. California just responded that the lawyers’ caveats live in the fine print — while the marketing lives on the dashboard.
And in the background, Tesla has already rebranded its top-tier package to “Full Self-Driving (Supervised)” and quietly dropped the “Full Self-Driving Capability” phrasing in California, which doesn’t exactly undercut the state’s argument.
The timing couldn’t be more awkward for CEO Elon Musk’s latest and greatest reinvention of Tesla as an AI company that just so happens to sell cars — and one that’s trying to graduate from driver-assistance drama into fully autonomous robotaxi mythology. The company is still testing its robotaxi service in Austin, Texas, with safety monitors, using an “unsupervised” version of its software to move cars around factory lots, and telling investors that future fleets of driverless Teslas will justify a tech-style valuation. The stock has been hovering near record highs, helped by robotaxi and AI buzz, even as EV demand softens and tax credits fall away.
But before Tesla can hit the ground running, it first needs to pick a lane. Tesla can rename Autopilot in favor of a less ambitious name, keep shipping software updates, and move on with a slightly less dramatic dashboard. Or it can prove that the feature really does meet California’s definition of self-driving and drag its biggest market into a fight over a name that already did most of its work on the way to a $10,000 checkout button.
Investors can keep paying for tomorrow’s robotaxis. But for now, Tesla has a few months to fix what it calls the feature that still expects someone to grab the wheel.
